The products and services that are offered for sale on Pay4SchoolStuff.com are provided by your school ("School") and its related community organizations ("Community Organization(s)"). This Agreement and the Policies referred to in this Agreement govern your use of Pay4SchoolStuff.com.
ACCESSING, BROWSING, MAKING PURCHASES AND OTHERWISE USING PAY4SCHOOLSTUFF.COM INDICATES YOUR AGREEMENT TO ALL THE TERMS AND CONDITIONS IN THIS AGREEMENT. PLEASE READ THIS AGREEMENT CAREFULLY BEFORE PROCEEDING.

LICENSE AND SITE ACCESS.Subject to the terms and conditions of this Agreement, PayGOV hereby grants you a limited, revocable, non-transferable and non-exclusive license to access and use Pay4SchoolStuff.com by displaying it on your internet browser only for the purpose of shopping for the products and services sold on Pay4SchoolStuff.com and not for any commercial use or use on behalf of any third party. Any breach of this Agreement shall result in the immediate revocation of the license granted in this paragraph, and the closing of your account, without notice to you.

Pay4SchoolStuff.com may offer items for use by children, but it offers them to adults, who can purchase with a credit card or via PayPal. PayGOV, your School and Community Organizations reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in their sole discretion.
You shall immediately notify PayGOV of any unauthorized use of your password or identification or any other breach or threatened breach of Pay4SchoolStuff.com's security.

Links.Pay4SchoolStuff.com may contain links and pointers to third party websites or resources. Links to and from Pay4SchoolStuff.com to third party sites do not constitute an endorsement by PayGOV, your School or Community Organizations of any third party websites or resources. Accessing such links is at your sole risk.

ELECTRONIC COMMUNICATIONS.When you visit Pay4SchoolStuff.com or send e-mails to us, you are communicating with us electronically. You consent to receive communications from us electronically. You also agree that we may share your communications with your School and Community Organizations at our option, and you consent to receive communications from your School and Community Organization. We will communicate with you by e-mail or by posting notices on Pay4SchoolStuff.com. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

CONTENT.PayGOV does not review the materials posted to Pay4SchoolStuff.com by your School and Community Organizations, and PayGOV is not responsible for any such materials posted. PayGOV is not responsible for the accuracy of any content or other information displayed or distributed through Pay4SchoolStuff.com; reliance upon such content and information is at your own risk.

INTELLECTUAL PROPERTY.Pay4SchoolStuff.com is protected as a collective work and/or compilation under United States copyright laws, international conventions, and other copyright laws. All intellectual property, including but not limited to, text, graphics, button icons, and images, is either owned or controlled by PayGOV, your School and Community Organizations, and its other licensors and suppliers, and is protected by US and international copyright laws. All software used on Pay4SchoolStuff.com is the property of PayGOV and its software suppliers and licensors.
"Payment Partnerships" is a US trademark owned by PPI, and its use without PPI's express written permission is prohibited.

INFRINGEMENT POLICY.If you believe that your work has been copied in a way that constitutes copyright infringement, please provide us with the written information as follows: (1) a description of the copyrighted work that you claim has been infringed upon; (2) a description of where the material that you claim is infringing is located on Pay4SchoolStuff.com; (3) your name, address, telephone number, and e-mail address; (4) a statement by you that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; (5) a statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf; (6) sign the document. PAYGOV MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF PAY4SCHOOLSTUFF.COM OR THE INFORMATION, CONTENT, MATERIALS, OR PRODUCTS AND SERVICES INCLUDED ON PAY4SCHOOLSTUFF.COM. YOU EXPRESSLY AGREE THAT YOUR USE OF PAY4SCHOOLSTUFF.COM IS AT YOUR SOLE RISK.
TO THE FULLEST EXTENT PERMISSIBLE BY APPLICABLE LAW, WE DO NOT MAKE AND YOU DO NOT RECEIVE ANY OTHER WARRANTY, EXPRESS OR IMPLIED. ANY RIGHTS OR LIMITS STATED HEREIN ARE THE MAXIMUM FOR WHICH WE, YOUR SCHOOL AND COMMUNITY ORGANIZATIONS, THIRD PARTY LICENSORS, PROVIDERS AND SUPPLIERS ARE COLLECTIVELY RESPONSIBLE.
YOUR REMEDIES AS SET FORTH IN THIS AGREEMENT ARE EXCLUSIVE.
CERTAIN STATE LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MIGHT HAVE ADDITIONAL RIGHTS.

PayGOV is not responsible for the products and services sold on Pay4SchoolStuff.com, nor for the content provided by your School and Affiliated Organizations, nor for the actions or non-actions of your School and Community Organizations, or the financial institutions that process the payments for your purchases made on Pay4SchoolStuff.com, and therefore does not issue refunds or handle disputes concerning payments on the website. Your sole remedies for refunds or disputes you may have with regard to purchases made on Pay4SchoolStuff.com are as set forth below:

• Refunds are the responsibility of the Affiliated Organization or School that listed the item. Pay4SchoolStuff is not responsible for issuing refunds. Please consult your School, PTA/PTO, Booster Club or other Affiliated Organization to determine their refund policy.
• If you have a dispute regarding any of the products and services that you have purchased on Pay4SchoolStuff.com, such as problems with quality or non-delivery, you must contact your School and/or Affiliated Organization that offered the disputed product or service (or you may call our toll free number, 1-877-EZPAYER/1-877-397-2937, for contact information.
• If you wish to dispute a charge or request a refund for a purchase made on Pay4SchoolStuff.com, you must contact the financial institution that processed your payment, such as your bank or credit card company, and follow their procedures for your dispute or request.

By visiting Pay4SchoolStuff.com, you agree that the laws of the Commonwealth of Virginia, without regard to principles of conflict of laws, will govern this Agreement and any dispute of any sort that might arise between you and PayGOV or your School and Community Organizations. You agree that venue shall be solely in Virginia, and that we will both submit to the jurisdiction of the federal or state courts, as appropriate, located in Virginia. We each consent to the exercise of personal jurisdiction by any such court with respect to any such proceeding, and consent to service of process by registered mail, return receipt requested, or in any other manner provided by law.
This Agreement, including this Terms of Service Agreement and our Privacy Policy, constitutes the entire Agreement between PayGOV and you with respect to your use of Pay4SchoolStuff.com.
